Cytokinetics Files Complaint on Patent Issue Against Bristol-Myers Squibb

Cytokinetics filed a complaint against Bristol-Myers Squibb, and its subsidiary MyoKardia, seeking a declaratory judgment that its heart disease therapy does not infringe on an existing patent.
The complaint is seeking to preliminarily and permanently block the defendants from threatening or initiating infringement litigation against Cytokinetics, the company said in a filing with the Securities and Exchange Commission on Thursday.
Cytokinetics is seeking protection against possible claims it infringed on what it refers to as the '697 patent, in connection with its heart disease therapy MYQORZO. The complain was filed in federal district court in Delaware.
As part of its filing the company is also seeking a judgment to block claims against customers, dealers, suppliers, sellers or distributors of MYQORZO, or charging any of them with patent infringement.
Bristol-Myers Squibb did not immediately respond to a request for comment.
